Immigration and Employment Law Update
*featuring Gil Sparks*
Homeland Security is again trying to implement rules that could have a major impact on employers. Gil will review these rules and the potential impact. He will also review the most important employment law cases that impacted employers over the last year.
The presentation will include an update on the status of the Department of Homeland Security’s (DHS) renewed push for a "no-match" rule that could require employers to fire employees for whom they have received a social security number no-match letter. Initially, DHS released its proposed rule in 2007, but backed off when the rule was rejected by a federal judge in October, 2007. In March 2008, DHS republished the proposed "no-match" rule. Gil will review the requirements of the proposed rule, if adopted , and provide an update as to the status of the rule’s probable implementation.
Other topics to be reviewed include:
* New Washington legislation allowing leave for victims of domestic violence, sexual assault or stalking (or whose family member is a victim and leave is necessary) and for family members whose spouse has been notified of a deployment during a period of military conflict;
* New federal FMLA leave provisions;
* The worker’s compensation traveling employee doctrine;
*Recent cases addressing overtime payment requirements;
* Pregnancy and disability discrimination updates;
* Compensation for travel time.
